One of the disadvantages for employers who resort to consensual termination of employment is that it may take longer to clarify the administrative details of letting go. This requires additional resources such as time and staff to work out the details of an agreement. If the misrepresentation has caused the represented person to enter into the contract, but the misrepresentation is not incorporated as the clause in the contract, the applicable legal remedy under customary law is termination of the contract.23 If the representative decides to exercise his right of withdrawal, the contract will be treated retroactively as void. This means that the service is reversed, all rights and obligations are eliminated, the pre-contractual position of the parties is restored and the contract is treated as if it had never existed. Recourse in the event of withdrawal is fundamentally different from the termination of a contract.
